TERMS AND CONDITIONS OF USE MEU COFRINHO

These Terms and Conditions of Use ("Terms") are entered into between the Participant and MeuCofrinho, and regulate the terms and conditions applicable to the services offered by MeuCofrinho through the digital platform.

Thus, this instrument contains the rules for using the services and the MeuCofrinho platform, as well as the operations and procedures that may be carried out by the Participant.

For the purposes of this instrument, the established terms, in the singular or in the plural, will have the following meanings:

“Fundraising Campaign”, campaign under the responsibility of the Fundraiser Participant that aims to receive donations for a specific purpose.

“MeuCofrinho Platform”, means the Fundraising and Donation platform that can be accessed through the website[ www.meucofrinho.com].

“MeuCofrinho”, company established in this instrument, responsible for managing the MeuCofrinho platform.

“Participant”, any and all natural or legal persons, individual or entity, regardless of the type, who request registration on the MeuCofrinho platform.

“Fundraiser Participant”, individual or legal entity, duly registered on the MeuCofrinho platform, responsible for the Fundraising Campaign.

“Donor Participant”, individual or legal entity, duly registered on the MeuCofrinho platform, who donated amounts to fundraising campaigns.

"Privacy Policy": is the applicable Privacy and Data Processing Policy, available on the MeuCofrinho Platform.

“Available Balance”, amount in national currency collected by the Fundraiser Participant in a Campaign, already deducting the applicable fees.

“Withdrawal”, procedure for releasing and transferring the balance available to the current account held by the Fundraiser Participant and for releasing and transferring any balance available in the register of the Donor Participant, for possible refund.

1. Acceptance of Terms and Conditions of Use

It is hereby established that access to the MeuCofrinho platform, registration on the website and use of the Services, together or individually, will result in agreement with these Terms.

Before accessing the MeuCofrinho platform, registering and using the services, the Participant must read, make sure that he has understood and accept all the conditions established in these Terms and in the MeuCofrinho Privacy Policy.

If the Participant does not agree with the terms set forth in this instrument or in the Privacy Policy, the Participant must not register, nor access, view, download or use in any way any page, content, information or service of MeuCofrinho.

These Terms may be amended at any time and at MeuCofrinho's sole discretion, by publishing the most recent version on the platform. Although MeuCofrinho may notify you of any changes, it is the Participant's duty to keep up to date with the Terms, so that access to the platform or use of the Services will bind the Participant to the updated version of the Terms.

2. Operations of MeuCofrinho and Services

The MeuCofrinho platform is a set of technological solutions that make it possible to create campaigns to fundraise through donations from interested third parties, as well as the management of the values ​​​​received for the Campaign created.

In this sense, the services provided by MeuCofrinho consist of providing a digital platform and other procedures necessary to create the Campaign for fundraising or donation of values, as well as the management and registration of donations received and made and transfers between Participants.

3. Participant Registration on MeuCofrinho platform, Maintenance and Cancellation

To use the MeuCofrinho platform and its features and services, the Participant must register in advance, by providing some personal data and information necessary for the provision of services.

Individuals or legal entities that meet the following requirements may register on the MeuCofrinho platform:

  • Individuals: Be absolutely capable, be at least 18 (eighteen) years old or be legally represented if a minor and have an active and regular ID Number;

  • Legal entities: Be legally represented in the form of their articles of incorporation, be active and regular before the Federal Revenue and be established in national territory.

The creation of more than one registration per Participant is expressly prohibited.

MeuCofrinho is allowed to carry out a prior analysis of the information provided by the Participant before the approval of the registration and release of use of the MeuCofrinho platform, which may include, without limitation, the performance of Know Your Customer and money laundering prevention procedures.

In this sense, the Participant must be aware that MeuCofrinho may request new information that is necessary for the correct registration, carry out research in financial institutions and databases, as well as deny the registration, whether motivated or not.

The login on the MeuCofrinho platform can be performed through third-party applications, such as social networks, according to the platform's functionalities, or through the login and password established in the registration.

The Participant is responsible for the security of access information to the MeuCofrinho platform, which is personal and non-transferable.

In case of loss or verification of improper use of their registration, the Participant must immediately notify MeuCofrinho through the communication channels established in these Terms.

It is the exclusive responsibility of the Participants to provide, update and guarantee the veracity of the registration data, and MeuCofrinho shall not be liable for any type of civil and criminal liability resulting from untrue, incorrect or incomplete data provided by the Participants.

MeuCofrinho reserves the right to use all valid and legal means to, if it deems necessary, at its sole discretion, confirm the data and information provided by the Participant and its credit status for the purposes of approving or maintaining the registration.

In case of incorrect or untrue information, inertia of the Participant in providing the necessary data and information, verification of credit restriction, non-compliance with these Terms or duplicate registration, MeuCofrinho may suspend, block or delete the Participant's registration, without any type of indemnity or reimbursement.

Furthermore, the Participant may cancel its registration at any time, without any charge, at its sole discretion, through the MeuCofrinho platform.

The cancellation of registration by the Fundraiser Participant, for any reason, depends on the Status of their created campaigns. Fundraisers with inactive campaigns will be able to close the Register normally. Fundraisers with active campaigns must withdraw the entire balance available in their campaigns, and close all their fundraising campaigns. The Registration of the Fundraiser Participant can only be closed after the balance available in all its campaigns is withdrawn.

MeuCofrinho reserves the right not to approve new registrations of Participants whose previous registration was closed due to irregularities of any nature.

4. Use of the MeuCofrinho Platform and Obligations of Participants

The MeuCofrinho platform values ​​the security, legality and veracity of fundraising campaigns and donations made through the platform.

In this sense, the Participants, whether Fundraiser Participants or Donor Participants, must follow the rules established in this instrument, including:

  • Participants must use the MeuCofrinho platform and the services provided in a manner appropriate to the legislation, for lawful purposes, in good faith and in accordance with morality and good customs, so that any form of use for illegal, defamatory purposes is prohibited. , discriminatory, abusive, offensive, pornographic, obscene, aggressive, injurious, vexatious, misleading, slanderous, violent, vulgar, or harassing, threatening or using false identity, that is, any shady use that could harm MeuCofrinho, other Participants or third parties.

  • It is forbidden to use the MeuCofrinho platform to create fundraising campaigns that aim to raise funds for criminal, commercial purposes, or that, in any way, may directly or indirectly expose MeuCofrinho, other Participants or third parties in a negative way. and violate the rights of third parties, under penalty of cancellation of the fundraising campaign or the Participant's registration.

  • The Participant must have, under his exclusive responsibility, all the software and hardware necessary to access the MeuCofrinho platform and its functionalities, including, but not limited to, a computer and/or mobile device with Internet access, with the appropriate and necessary technical requirements for the operation of the platform.

  • Participants must keep all necessary data and information up to date with regard to registration on the platform, as well as provide all clarifications and additional information requested by MeuCofrinho.

  • Participants must refrain from using any information made available by other Participants, even publicly, for any purposes that are not previously authorized by the holders of said information.

  • Donor Participants must only use financial resources of legal and declared origin, and the use of resources that may be considered illegal or from unauthorized third parties is prohibited.

  • Fundraiser Participants must use the Balance fundraised exclusively for the purposes informed in the specific campaign, and must collaborate with information and documents that prove the proper use of said Balance, whenever requested by MeuCofrinho, at its sole discretion.

5. Creation of Fundraising Campaigns

Fundraiser Participants will be able to create Fundraising Campaigns on the MeuCofrinho platform, aiming to receive financial resources through donations from Donor Participants.

Fundraising Campaigns must follow, in addition to the other rules established in this instrument, the following rules:

  • All Fundraising Campaigns must, without exception, contain a photo that illustrates their purpose, as long as they are suitable for the public of all ages, in accordance with the general guidelines established in this item.

  • Every Fundraising Campaign will have a unique ID and access link, in order to facilitate the identification of campaigns and control by the Collector Participant and MeuCofrinho.

  • The purpose of the Fundraising Campaign shall be in accordance with the principles and obligations set forth in these Terms.

  • If the Fundraising Campaign violates any obligations and rules of this instrument, MeuCofrinho may suspend, block or disable the Fundraiser Campaign, at its sole discretion and without any compensation to Fundraiser Participant.

  • Fundraising Campaigns may not infringe the copyright, patent, trademark, trade secret or other intellectual, industrial or publicity or confidentiality or personality rights of third parties.

  • When the Fundraising Campaigns are linked to obtaining donations for third parties, including minors, the Fundraising Participant must guarantee, under its sole responsibility, that it has prior and express authorization from said third party or their legal guardians to carry out the Fundraising Campaign.

  • All Donation Campaigns will be previously analyzed by MeuCofrinho to verify compliance with internal rules. The analysis will not grant definitive approval, so that if irregularities are found, even if they exist at the time of the analysis, MeuCofrinho may, at its discretion, suspend, block, cancel or disable the Fundraising Campaign, without any type of indemnification to the Fundraiser Participant.

  • The Campaign may be changed by the Fundraiser Participant exclusively with regard to its goals and deadlines for collection and general information, so that its purpose and identification must remain as registered.

  • It will be allowed, exclusively, the fundraising of values ​​in national currency.

For the identification of the Campaign, whether by name, image and general information available on the MeuCofrinho platform, it is suggested that you use names, images and information that are not protected by copyright, intellectual property or that depend on authorization from third parties to be used. . Also, personal data, images and information in general of children and adolescents should be avoided.

If a name, image or general information is used that depends on the prior and express authorization of third parties, the Fundraiser Participant will be solely and exclusively responsible for obtaining such authorizations and must make the authorizations available to MeuCofrinho whenever requested.

The Fundraiser Participant will be able to check the Balance collected and other information about the Fundraising Campaign through the MeuCofrinho platform.

6. Supporting Campaigns and Making Donations

In order for the Donor Participant to make donations to Fundraising Campaigns of interest, they must complete and provide the requested information and must choose the forms of donation made available by the MeuCofrinho platform at the time of donation, such as credit cards and PIX.

The minimum amount for donation is R$ 10.00 (ten reais). The donation must be approved by MeuCofrinho if it exceeds R$ 20,000.00 (twenty thousand reais).

All transactions will be duly registered on the MeuCofrinho platform through an Identification Code for monitoring by the Donor Participant.

In case of regret, the Donor Participant may request the cancellation of a donation within a maximum period of 5 (five) business days after said donation. After this period, the Donor Participant will not be able to cancel the donation and will not be entitled to any refund.

The processing of the donation will be subject to the release and approval by the responsible financial institution, as well as any previous analysis by MeuCofrinho, in case of suspected fraud.

The Donor Participant must observe all other rules and observations established in this instrument.

7. Payment Rules

The Donor Participant's payment methods for making the donation are: i) credit card; and ii) PIX.

Payment processing will be the responsibility of an outsourced payment institution, to be contracted directly by MeuCofrinho. The Fundraiser Participant declares that it is aware that, in order to receive the funds raised, it will be opening a MeuCofrinho sub-account with the Payment Institution.

MeuCofrinho will work together with the financial institution to register on the MeuCofrinho platform all amounts donated and fundraised by Participants.

Any dispute regarding donations made that results in suspension or cancellation of the donation must be resolved only between the Participants and the respective financial institution, and MeuCofrinho will not be held responsible for processing payments made with the payment institution or financial institution.

The Participant hereby authorizes MeuCofrinho to carry out the reversal and cancellation of donations made irregularly, illegally or in breach of the conditions set forth in these Terms.

It is established that any chargebacks made to the Donor Participant will be credited to the payment method registered on the Platform for the appropriate donation.

The Fundraiser Participant declares that it is aware that the Donor Participant may cancel the donation within a maximum period of 5 (five) days, counted from the date of the donation, so that the amounts will be automatically refunded, without any compensation to the Fundraiser Participant in this regard.

The gross amount, the Total Balance, the amount available for Withdrawal and the amount withdrawn for each Fundraising Campaign will be made available by MeuCofrinho to the Fundraiser Participant on the MeuCofrinho platform, which can be consulted while the Campaign is active.

8. Liquidation and Withdrawal Rules

For the settlement of the donated or collected amounts to be carried out, the Participant must have a suitable and regular bank account in a national financial institution and adequate to receive or transfer the amounts.

The amounts collected will be made available for Withdrawal by the Collector Participant within the following deadlines:

  • Donation With National Origin: Minimum period of 05 (five) business days; and

  • Donation with International Origin: Up to 35 (thirty-five) business days.

All Withdrawals requested by the Collector Participant will be confirmed by email and, if necessary, authenticated by a double factor, including by requesting a copy of the ID and ID Number, at MeuCofrinho's discretion, whenever it deems necessary in view of Fundraiser Participant must have registered his/her bank details, which must be in the Fundraiser's name.

All Withdrawals to be carried out by the Fundraiser Participant will be carried out according to the Available Balance, already deducting all applicable fees.

The Withdrawal related to a Fundraising Campaign can be made in a fractional way, so it will not be necessary to reach the goal to make the Withdrawal.

Withdrawal will not affect the performance of the Campaign in terms of percentage collected, so even with the Withdrawal of the total amount or fractional, the percentage of collection will not change.

The amounts will be made available in the account informed by the Collector Participant within 03 (three) business days, counted from the withdrawal request date.

In case of suspected fraud, the Withdrawal may be temporarily suspended, until the analysis of the legality of the Withdrawal is completed, for security reasons.

9. Fees and Other Charges

The use of the MeuCofrinho platform is subject to the Fundraiser Participant paying the following fees:

  • Administrative Fee: charged from Fundraiser Participants for the availability of the MeuCofrinho platform and services, is a fee of 6% (six percent) that is levied on the gross balance collected.

  • Withdrawal Fee: charged to Fundraiser Participants for each Withdrawal. Fee charged by the Payment Institution.

  • Payment Fees: Fees charged from Fundraiser Participants in view of the financial operations carried out to make the donation, corresponding to BRL 3.49 (three reais and forty-nine cents) for payments received by donation by means of a bank slip, 1.19% (one point nineteen percent) of the amount received from each donation made by PIX, and 3.36% (three point thirty-six percent) of the amount received from each donation made by credit card. R$ 0,99 flat fee per donation made by credit card.

MeuCofrinho may readjust or change the fees and billing methods at its sole discretion, so that after the readjustment or changes will be applied to Fundraising Campaigns initiated after the readjustment or changes.

In addition to the fees mentioned above, as a result of the donation or collection, there may be the incidence of taxes and legal charges. Participants will be exclusively responsible for the payment and collection of taxes levied on operations carried out through the MeuCofrinho platform and must hire specialized consulting, in case of doubts.

10. Guarantees and Responsibilities of MeuCofrinho and Participants

The Participant declares that he is aware and agrees that MeuCofrinho disclaims any liability for any representations or warranties implied or not expressly provided herein, including, without limitation, any guarantees of suitability of the MeuCofrinho platform for a specific purpose. MeuCofrinho will not, under any circumstances, be responsible for indirect, material or moral damages, as well as loss of profits, caused by, or related to, the existence or use of the MeuCofrinho platform and/or services.

MeuCofrinho does not guarantee that the MeuCofrinho platform and/or the services will serve the purposes intended by the Participants, nor that the MeuCofrinho platform and/or the services are free from errors, possible interruptions or failures, or that the MeuCofrinho platform and/or the services will be compatible or work with any third party or Participants' software, applications or services. Participants acknowledge that the MeuCofrinho platform and/or services may not be available or may be unavailable due to several factors, including, without limitation, periodic system maintenance (scheduled or not), manifestations of nature, technical failures of the platform software, infrastructure of telecommunications or delay or interruption caused by viruses, denial of service attacks, increase or fluctuation in demand, actions and omissions of third parties or any other cause beyond the control of MeuCofrinho.

In addition, the User declares that he is aware that access to the Services is done digitally, being essential, for that, to have an internet connection. MeuCofrinho is not responsible for the quality of your internet connection.

MeuCofrinho will not be liable for damages caused by acts of other Participants.

The Participants will be solely responsible for damages of any nature caused to MeuCofrinho and third parties and for any unlawful practices they commit.

11. Intelectual Property

The brands, names, logos, domain names and other distinctive signs, as well as the MeuCofrinho platform are the exclusive property of MeuCofrinho.

The Participant shall not copy, reproduce, republish, transmit, distribute or in any other way use any content or distinctive signs of MeuCofrinho, in whole or in part, without the prior and express authorization of MeuCofrinho.

Through the registration, MeuCofrinho will grant a temporary, onerous and full license to use the MeuCofrinho platform for the Participant to use the MeuCofrinho platform and the services, while the Participant's registration is active and regular. The Participant may not use the platform for any purpose other than that established in this instrument.

The Fundraiser Participant must use data, images and information that it owns and has all authorizations to use data, images and information from third parties.

The Fundraiser Participant authorizes that all data, images and information used in a Fundraising Campaign be kept for an indefinite period on the MeuCofrinho platform, even if the fundraiser has ended, at the sole discretion of MeuCofrinho.

12. Third-party content

Third-party services, products and content made available on the MeuCofrinho platform, even if they have a connection with MeuCofrinho, are the sole and exclusive responsibility of the third party. The Participant acknowledges and agrees that MeuCofrinho does not guarantee, does not endorse, does not assume and will not have any liability with respect to products, services or third-party websites.

MeuCofrinho is not responsible and does not offer any guarantee of the accuracy, effectiveness, timeliness and adequacy of any information, content, product or service provided by third parties, including hyperlinks to third party pages.

13. Term and Termination

These Terms are entered into between each Participant and MeuCofrinho individually for an indefinite period, starting from their acceptance by the Participant, which will occur at the time of requesting registration on the MeuCofrinho platform.

These Terms will remain in effect while the Participant's registration is active and while the MeuCofrinho platform is in operation. These Terms will be automatically terminated in the event of termination of the Participant's registration for any reason or in case of cancellation of operation of the MeuCofrinho platform, whichever occurs first.

MeuCofrinho reserves the right to temporarily or permanently interrupt the operation of the platform and/or the provision of services, at its sole discretion, without any compensation to the Participant in this regard, so that these Terms will be automatically terminated.

In the event of termination of these Terms for any reason, MeuCofrinho shall release the Balance corresponding to the Fundraising Campaign for the Fundraisers and any remaining balances held by the Donor Participants, under the terms established in this instrument.

14. MeuCofrinho Platform Management

The MeuCofrinho platform is managed by the company [MEU COFRINHO NEGÓCIOS VIRTUAIS LTDA], registered with the CNPJ/ME under No. [45.700.954/0001-45], headquartered at [Al. Santos 200, Cerqueira Cesar, São Paulo/SP - CEP: 01418-000 ].

In case of questions and clarifications regarding these Terms, the Participant may enter with MeuCofrinho through the [contato@meucofrinho.com].

15. General Provisions

  • Comprehensive Agreement. The provisions of these Terms, as well as those of its annexes, considered integral and complementary parts of this instrument, reflect the integrity of the understandings and agreements between the Parties.

  • Binding character and succession. These Terms are irrevocably entered into, and their obligations are legal, valid and binding on the Parties and their successors and heirs in any capacity and enforceable in accordance with their respective terms.

  • Independence. In the event that any Clause, term or provision of these Terms is held to be void or unenforceable, such nullity or unenforceability will not affect any other Clauses, terms or provisions contained herein, which will remain in full force and effect.

  • Renounce. Failure to exercise any rights or agreement to fail to comply with any terms or conditions under these Terms will not constitute a waiver of any rights under these Terms nor will it prevent said Party from enforcing or exercising any of these rights at any time.

  • Tolerance. No tolerance or delay by either Party in enforcing or demanding compliance with the rights and obligations agreed in these Terms shall constitute novation or precedent of any nature. Such tolerance will not harm or restrict the exercise of the same rights and obligations in similar future situations, nor will it exempt, in any case, any of the Parties from the full compliance with its obligations in accordance with the agreement and provision herein.

  • Applicable Legislation. These Terms will be governed by the laws of the Federative Republic of Brazil.

  • Forum. The Parties elect the Forum of the Judicial District of São Paulo, State of São Paulo to resolve any doubt or controversy relating to these Terms, with express waiver of any other, however privileged it may be or that it may be.
